1. Scope and business use
These Terms govern access to BOOYAKKA by organisations and people acting for them. Unless BOOYAKKA expressly agrees otherwise in writing, the service is supplied for business, organisational or professional purposes.
2. Accounts and authority
You confirm that account information is accurate and that the person accepting these Terms has authority to bind the organisation. You are responsible for staff accounts, permissions and activity performed through your organisation.
3. Service
We grant a limited, non-exclusive, non-transferable right to use BOOYAKKA during an active trial or subscription. Features, limits and support depend on the selected plan. We may improve, replace or retire features where reasonably necessary.
4. Customer content and compliance
You remain responsible for content, events, memberships, communications and data entered by your organisation. You must have all permissions, licences and lawful bases required to use that material and operate your activities.
5. Availability and maintenance
We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Planned maintenance, emergency work and third-party outages may affect access.
6. Charges
Charges, trials, renewals and cancellations are governed by the Subscription Terms. Ticket and event payment arrangements may be separate from the organisation's BOOYAKKA software subscription.
7. Suspension and termination
We may restrict or suspend access where reasonably necessary for security, non-payment, legal compliance, material breach or protection of users and the platform. Where appropriate, we will give notice and an opportunity to remedy the issue.
8. Liability
Nothing excludes liability that cannot lawfully be excluded. Subject to that, BOOYAKKA is not responsible for indirect or consequential loss, loss caused by customer content or instructions, event performance, third-party services, or matters outside our reasonable control. Our aggregate liability arising from the service is limited to the subscription fees paid by the customer during the 12 months before the event giving rise to the claim.
9. Governing law
These Terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction, unless mandatory law requires otherwise.
10. Changes
We may update these Terms. Material changes will be communicated reasonably in advance where practicable and will take effect from the stated effective date.
